The petitioner had approached this Court being aggrieved by the judgment of the Industrial Court dated 16/07/2007, by which, his Complaint (ULP) No. 30/2007 has been dismissed. The petitioner had challenged his transfer order dated 22/03/2007 before the Industrial Court. 3.
While admitting this petition, this Court refused interim relief to the petitioner and directed him to join as a peon at the place of transfer on 25/07/2007 at 11.00 a.m.

In view of the above, I do not find that the cause of action in this petition would survive after 12 years of the transfer and in view of the direction of this Court to the petitioner to report at the place of transfer. 5.
Considering the above, this petition being infructuous, is disposed off. Rule is discharged.

In the event, the petitioner comes up with an application contending that his grievance still survives and prays for restoration of this petition, the same would be considered in the facts and circumstances set out in the application. (RAVINDRA V. GHUGE, J.) shp/-
