PER COURT :- Since the applicant expressed inability to furnish bank guarantee, while considering Civil Application No. 1999/99, this Court issued directions to invest the said amount in the fixed deposit in nationalized bank until disposal of appeal. The applicant, now contends that, he is in a position to secure bank guarantee and furnish it to the Court and that he would keep the bank guarantee alive until disposal of the first appeal. In this view of the matter, the order passed by this Court in CA No.10226/07 decided on 3.3.2008 is restored and the order dated 13.2.2009 in CA No.1999/09 stands superseded.

Civil application is disposed of.
