Heard. Perused First Information Report ('F.I.R.') and related police papers.

Applicant No.1 has allegedly assaulted the informant on his head with an axe. The head injury is grievous in nature. Photographs thereof have also been placed on record. Therefore, this Court is not inclined to grant him anticipatory bail.

In view of same, learned counsel comes around to seek withdrawal application so far as Applicant No.1 is concerned. 1 / 2

So far as other two applicants are concerned, Applicant No.3 is a lady. The injury caused due to assault by Applicant No.2 is simple in nature. Hence, the following order :-

ORDER

(I) Application is partly allowed.

(II) Application of Applicant No.1 - Kishor Ramkrushna Devgude stands disposed of as withdrawn.

(III) Order dated 18th April, 2023 granting Applicant No.3 - Manisha Kishor Devgude interim anticipatory bail is hereby made absolute.

(IV) In the event of arrest of Applicant No.2 Ravindra Ramkrushna Devgude, in connection with Crime No. 46 of 2023 registered with Shirur Police Station, Dist. Beed for the offences punishable under Sections 307, 323, 324, 504 and 506 read with Section 34 of the Indian Penal Code, he be released on executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety in the like amount.

(V) Applicant Nos.2 and 3 shall appear before the investigating officer, as and when required for the investigating purpose.

(VI) They shall not tamper with the prosecution evidence. ( R.G. AVACHAT, J. ) SSD 2 / 2
