Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The conditional temporary bail was granted to the applicant on depositing the entire amount as proposed by himself by order dated 17.11.2022. However, he could not deposit the said money. Hence, further two months time was extended by order dated 17.02.2023.

3. Today, the learned counsel for the applicant seeks further time to pay the amount and ready to deposit Rs.21,00,000/- only with the Trial Court. The proposal of the applicant was accepted to test his bonafide, but it seems that it was not

22-BA.933-22+1.odt bonafide. Today was the last date to comply with the orders to deposit the money. It was the condition that if he would not deposit the money, he would immediately surrender before the Superintendent of Prison. From the conduct of the applicant it seems that he wanted to kill the time and stay out of the prison. When he himself undertook to deposit the entire amount and could not deposit, no installments can be granted. Therefore, further time to deposit money is not extended and temporary bail granted earlier stands cancelled. Accordingly, Criminal Application No.1488 of 2023 stands disposed of. 4.

The applicant to surrender before the Superintendent, Osmanabad Sub Jail by tomorrow morning i.e. on 18.04.2023 by 11.00 a.m.
