The applicant - appellant has moved this application for condonation of 72 days delay in filing the appeal against the impugned judgment and order passed by the Tribunal for the reasons set out in the application.

Heard learned counsel for the applicant - appellant and the respondents.

Considering the submissions advanced in the light of overall facts of the case, the reasons assigned to condone the delay and the pleadings made in the application remain unchallenged, I am of the view that the delay in filing the appeal has been sufficiently explained and the case is made out to condone the

915-CA-5754-2018 (D) delay.

Accordingly, the application is allowed in terms of prayer clause (B) subject to payment of cost of Rs.5,000/- to be paid by the applicant - appellant to the Government Cancer Hospital at Aurangabad within two weeks from the date of this order. Failure to deposit of cost, the application stands dismissed without further reference to the Court.

On deposit of cost, appeal be registered and place for admission on 29.08.2018.
