Order :-

1. Issue notice to respondents. Learned Assistant Government Pleader waives service for respondents.

It is the contention of the petitioners that though their applications seeking regularization of encroachment over the Gairan land are pending almost one year, however, they are not being decided as yet.

Learned Assistant Government Pleader states that respondent- - concerned authority would decide the same on its merits and in accordance with policy.

Considering the above, we pass the following order- In case the applications of the petitioners (Exhibit-B Colly) are pending, with respondent - concerned authority seeking regularization of encroachment over the Gairan

2 WP-4637.16 land, it shall be decided by the concerned authority in accordance with law and as per the existing policy, as expeditiously as possible, preferably within a period of nine months, from the date of this order.
