Since the Applicant is apprehending arrest at the hands of Itwara Police Station, Dist. Nanded in Crime No.05/2025 registered for the offence punishable under Sections 109 (1), 118 (1), and 3 (5) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'), he has filed this Application for Anticipatory Bail.

Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers on record.

The above referred Crime came to be registered on the Report lodged by one Shaikh Riyaz that, in the afternoon of 04.01.2025 he was assaulted by the two Accused by the Hammer on the head. The Informant suffered injury in the assault and he was hospitalized. The

Applicant is not named in the FIR. The Informant named the Applicant in the Supplementary Statement recorded after six (6) days from the lodging of the FIR. The CCTV footage of the incident is seized by the Investigating Officer. According to the learned APP, the Applicant is also seen in the same, however the Applicant is not named in the FIR. The main Accused, against whom the role of assault is attributed in the Report, is released on bail. It is nobodies case that the Applicant has flouted any of the conditions imposed in the interim order dated 24.09.2025. The investigation is over and the Charge-sheet is also filed. In this view of the matter, the following Order is passed.

O R D E R

(i) The Interim Order dated 29.04.2025 is confirmed. (ii) Application stands disposed off.
