The petitioner is before us seeking direction to the trial court for expediting the criminal case initiated by him against the respondent under Section 138 of the Negotiable Instruments Act. 3.

We cannot exercise the powers under article 226 of the Constitution ignoring the pendency before the trial court. If at all the petitioner can make out the grounds which would enable the trial court to take up his matter out of turn depending upon the priorities, the trial court may take such decision. We cannot undertake that exercise.

The Criminal Writ Petition is disposed of with liberty to the petitioner to approach the trial court and to make out the ground for grant of relief which he is claiming before us.
