1) Heard the learned counsel for respective parties.

2) By this petition, the petitioner seeks quashing and setting aside the advertisement dated 16.3.2013 published by Director of Education/Respondent No.2 and further directions to Respondent Nos. 1 and 2 to invite fresh applications for grant of letter of intent to open secondary schools at village Fulkalas, Tq. Purna District Parbhani by applying the Government Resolution dated 25.11.2013.

3) In pursuance to the notice issued to the respondents, Respondents have filed the affidavit in reply. In para 5 thereof, it is stated thus, - "5...The respondents have already

undertaken in PIL No.110 of 2014 to complete the process of decision making with regard to the opening of new school by the end of 30.5.2016 by filing an affidavit in reply in the PIL No. 110 of 2014 to decide all the pending applications in accordance with the directions issued by this Hon'ble High court in Writ Petition No. 1566 of 2013 and 2056 of 2014."

4) In the light of aforementioned assurance given by the respondents, the respondents are bound to consider the pending proposal of the petitioner. We make it clear that, the respondents shall treat the proposal of the petitioner pending as on date and consider the same in accordance with the Government Policy, while considering other proposals for the next academic year. All the contentions raised on merits in this petition are left open, to be agitated at appropriate time.

5) The petition stands disposed of on above terms.
