This is an application for grant of leave to file Appeal against the order passed by learned Judicial Magistrate, First Class, Aurangabad, in S.C.No.5691 of 2016.

The complaint filed by the present applicant for the offence punishable under Section 138 of the Negotiable Instruments Act is dismissed under Section

2 CriApln 2012/17 256 of the Criminal Procedure Code by the Chief Judicial Magistrate, Aurangabad. It is the contention of the applicant that his mother died and due to which he did not take necessary steps. He undertakes to produce said record. In view of the undertaking, application is allowed. Leave granted to file Appeal. 3.

Appeal is admitted. Issue notice to the respondent in Appeal. Learned counsel for the respondent waives service of notice on behalf of the respondent.
