Heard the learned counsel for the petitioner and the learned A.P.P. representing the State. 2.
The Registry of this Court has received a report from the Additional Sessions Judge, Ambajogai, wherein it is stated that though the Non-Bailble Warrant is issued against the petitioner and also the coaccused, they are not appearing before the Court. The next date fixed before the said Court is 3rd November, 2016. Since the petitioner is avoiding to appear before the concerned court, we are constrained to observe that we are not inclined to invoke extra ordinary writ
criwp565-2016 jurisdiction in favour of the petitioner. Therefore, on this count alone, we are not inclined to entertain this writ petition. Hence, the Criminal Writ Petition stands rejected.

However, rejection of this writ petition should not be construed as an impediment for the petitioner in case he is advised to file an application for discharges before the concerned Court, in case the charge is not yet framed.
