Present application has been filed for quashing the proceedings in Regular Criminal Case No.2249 of 2024 pending before the learned Judicial Magistrate First Class, Aurangabad arising out of the FIR vide Crime No.53 of 2024 dated 13.03.2024 registered with Harsul Police [1]

Station, District Chhatrapati Sambhajinagar for the offences punishable under Sections 498-A, 323, 504, 506 read with Section 34 of Indian Penal Code.

Since there is a matrimonial dispute and now it has been settled, respondent No.2/informant has resumed the cohabitation and it is stated that she is residing with the husband since 19.09.2024. She states that now applicant No.1 is taking good care of her and now she is pregnant. The terms of affidavit are got verified from learned Registrar (Judicial) and he has submitted report on 30.04.2025.

In view of the said compromise, as respondent No.2 is cohabiting with the husband and now they are leading happy married life and she has given her no objection for quashment of the proceedings, this is a fit case where we can exercise our powers under Section 482 of the Code of Criminal Procedure. Hence, the following order :-

ORDER

I) Criminal Application stands allowed.

II) The proceedings in Regular Criminal Case No.2249 of 2024 pending before the learned Judicial Magistrate First Class, Aurangabad arising out of the FIR vide Crime No.53 of 2024 dated 13.03.2024 registered with Harsul Police Station, District [2]

Chhatrapati Sambhajinagar for the offences punishable under Sections 498-A, 323, 504, 506 read with Section 34 of Indian Penal Code, stand quashed and set aside as against the present applicants.
