This is an Application under Section 482 of the Code of Criminal Procedure [hereinafter referred to as 'Cr.PC'] for quashing of FIR bearing Crime No.167/2022 registered with Shivajinagar Police Station, Latur, District Latur for the offence punishable under Sections 498-A, 323, 504, 506 read with Section 34 of the Indian Penal Code and consequential Charge-sheet bearing No.138/2022 in RCC No.69/2020 pending with Judicial Magistrate, First Class, Latur.

Heard the learned Advocate for the Applicants, the learned APP for Respondent No.1 and the learned Advocate for Respondent No.2.

The Applicants are the husband and the mother-in-law of Respondent No.2, who is the Informant in the aforesaid case.

The learned Advocate for the Applicants and learned Advocate for Respondent No.2 submit that the parties have amicably settled the matter and they have decided to stay together happily. Applicant No.1 and Respondent No.2 are personally present in the Court. Learned Advocate for Respondent No.2 places on record the Affdavit sworn in by Respondent No.2, wherein, it is contended that in view of the amicable settlement, the aforesaid proceeding may be quashed. The Affdavit is taken on record.

Learned APP submits that this is dispute between the husband and wife.

Considering the nature of offence and the above referred factual aspects regarding amicable settlement, we are inclined to exercise the powers under Section 482 of Cr.PC and proceed to pass the following order :
ORDER
(i) Application is allowed in terms of prayer clause - C-1 and the same is disposed of accordingly.
