The applicant has taken out this application seeking condonation of 228 days delay caused in filing application seeking leave to file appeal against the judgment and order passed by the trial Court.

Heard learned Counsel for the applicant and respondent. In nutshell, it is say of the learned Counsel for applicant that the delay was not deliberate but, it is caused due to prosecuting remedy before other Court on

Having considered the cause assigned for condonation of delay and the submissions advanced, I am of the view that sufficient cause has been made out to condone the delay.

Application is allowed in terms of prayer clauses (B) and (C). Delay is condoned. Application stands disposed of.

Application seeking leave to file appeal be registered and placed for hearing on 5th July, 2017. Learned Counsel for respondent waives notice for respondent.
