Heard the respective counsels.

Perused the impugned judgments and orders. The applicant appears to have a good case on merit. There were no complaints of jumping over the bail. Hence, the application deserves to be allowed. Hence, the following order :

ORDER

(i) Criminal Application is allowed.

(ii) The execution of the sentence to suffer SI for one year for the offence punishable under Section 377 r/w 34 of Indian Penal Code imposed by the learned Judicial Magistrate First Class, Nanded in RCC No.950 of 2003 dated 22.03.2013 and confirmed by the learned Sessions Judge, Nanded in Criminal Appeal No.45 of 2013 by its judgment and order dated 31.03.2023, stands suspended till conclusion of the revision application.

41-appln-1506-2023.odt (2) (iii) The applicant shall be released on bail on executing P.B. and S.B. of Rs.50,000/- with one solvent surety of the like amount. (iv) Bail before the learned Sessions Judge, Nanded. (v) Issue notice to the State. Learned APP waives notice for the respondent-State.

(vi) List the revision application on 30.06.2023. (vii) Call Record and Proceedings.
