The State Of Maharashtra v. Sakhahari Tulshiram Kendre And Another
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 84 FIRST APPEAL NO. 1191 OF 2016 THE STATE OF MAHARASHTRA
VERSUS
SAKHAHARI TULSHIRAM KENDRE AND ANOTHER
CORAM:
VIJAY S.KULKARNI REGISTRAR (JUDL) DATED:
14/03/2017 1.
Perused record and proceeding. The office note indicates that notice issued to sole respondent Sakhahari Tulshiram Kendre returned unserved due to his death. The bailiff report filed on record dated 18/08/2016 clearly indicates that respondent Sakhahari Tulshiram Kendre died before one year. Thereafter no steps have been taken by the appellant to bring on record L.Rs. of deceased respondent. There is no representation on behalf of the appellant. About four chances have been given to the appellant for taking steps. In view of the above, it appears that the appellant is not really interested in taking steps and to remove the objection. In the result, I pass following order.
ORDER
The appeal against sole respondent Sakhahari Tulshiram Kendre stands abated.
