Heard learned counsel for the applicants.

Present application is filed by the applicants-legal representatives of the deceased appellant - Babu Abaji Yamgar, for bringing them on record, being legal heirs of the deceased.

For the reasons stated in the application, the same is allowed in terms of prayer clauses "B" and "C". The delay caused in preferred the present civil application stands condoned. The abatement order is set aside.

The applicants to carry out necessary amendment in the memo of appeal.

The civil application is allowed in aforesaid terms and stands disposed of.
