The petitioner is aggrieved by the order dated 7.3.2017, whereby the trial Court has rejected the application Exhibit 18, praying for staying of RCS No.97 of 2015 in the light of an earlier suit RCS No.695 of 2012.

Learned counsel for the petitioner, submits on instructions, that the petitioner desires to withdraw this petition with liberty to move an application before the appropriate authority for clubbing both the civil suits, which are presently before the same Court. 4.

BENCH AT AURANGABAD 2 - WRIT PETITION NO. 8402 OF 2017 In the event the petitioner prefers an application before the competent authority seeking clubbing of the suits, the said authority would consider the said application on it's own merits and upon hearing the parties, as early as possible and preferably within a period of three months.
