FARAD CONTINUATION SHEET NO.
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
APPELLATE SIDE, BENCH AT AURANGABAD FIRST APPEAL NO.1 OF 2003 Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions and Registrar's orders.
Court's or Judge's orders Mr.S.G.Sangle, Asstt.Govt. Pleader for the State. Mr.S.S.Wagh, advocate for Respondent.
CORAM : S.V.GANGAPURWALA,J.
Date : 26.08.2015.
PER COURT :
1.
Heard.
2.
Mr.Sangle, learned Asstt.Govt. Pleader submits that the Reference Court has enhanced the compensation and awarded Rs.780 Per Are to the Respondent for his acquired land. In fact, the SLAO has rightly considered the compensation amount at the rate of Rs.700 per Are. The learned Asstt. Govt. Pleader submits that without any basis the compensation amount has been enhanced. 3.
I have gone through the Judgment. The Reference Court has considered the property acquired being irrigated land, so also has considered the sale transaction dated 3.1.1984, which is two years prior to the notification U/s 4 of the Land Acquisition Act and has considered it for the purpose of computing the market value. The total amount of enhanced compensation in the present
matter is only Rs.15,120/- (Rupees fifteen thousand one hundred twenty only).
4.
Considering the meager amount of enhanced compensation, so also the fact that Reference Court has considered the sale transaction while valuing the land.
5.
No case for interference. The First Appeal is dismissed. No costs.
