2] In view of availability of alternative remedy by way of appeal availed by the petitioner by filing an appeal before the Commissioner of State Excise i.e. the respondent no.2, the appeal can be disposed of by directing the respondent no.2 to hear and decide the appeal in a time bound manner.

3] The petitioner is directed to appear before the respondent no.2 on 6.5.2019. On appearance of the petitioner, the respondent no.2 is directed to hear and decide the appeal as expeditiously as possible and

WP 4888/19 - 2 - preferably within a period of four weeks from the date of this order.

4] It is expressly made clear that this Court has not examined merits of the case of the petitioner and all contentions raised are kept open to be raised before the respondent no.2.

5] The petition is disposed of in above terms.

6] Learned AGP is directed to communicate the order to all concerned.
