By this application, applicant seeks condonation of delay in filing Civil Application seeking restoration of the Review Petition No. 7705 of 2006.

After hearing learned Counsel for parties, we are of the view

2 CA 5162-2015 A that the applicant has made out case for condonation of delay and for restoration of the Review Petition, on the condition that the applicant shall pay cost of Rs. 1000/- (Rs. One thousand only) to the High Court Bar Library, within two weeks from today.

Copy of the receipt shall be produced before the Shirastedar of this Court, within two weeks from today.

Order dated 28th January 2010 passed by this Court in Writ Petition (Stamp) No. 1231 of 2010 is recalled in so far as Review Petition No. 7705 of 2006 is concerned.

Delay in filing Civil Application is accordingly condoned subject to the condition aforesaid.

Civil Application is disposed of in aforesaid terms. 7.

Applicant is permitted to serve copy of the Review Petition upon the office of the Government Pleader, within one week from today. Learned Government Pleader, in that event, can file Vakalatnama on behalf of the respondents.
