The appellant is assailing the order passed by the learned Single Judge in Writ petition No.5089/2011 decided on 9.3.2012. The order of rejection of application seeking injunction in RCS No.343/2010 was questioned before the District Judge, Kopargaon. The appeal presented by the appellant came to be dismissed by the District Judge and such concurrent orders passed by the Courts below were subjected to challenge before the learned Single Judge. The learned Single Judge also refused to cause interference in the matter and dismissed the writ petition. Admittedly, there is no injunction clamped against the respondent as requested by the appellant. After lapse of more than five years, the appeal questioning the legality of the order passed by the learned Single Judge does not deserve consideration. The ends of justice would be met in directing the Joint Civil Judge (J.D.), Kopargaon to decide the pending suit expeditiously and preferably within a period of six months from today and it is accordingly directed.
