The petitioner, presently lodged with the Aurangabad Central Prison, has been granted parole under the orders of the Jail Superintendent dated 27.11.2020. This petition is filed for seeking relaxation/ modification in some of the conditions. 2.

We have heard the learned advocate for the petitioner and the learned prosecutor on behalf of the respondents. 3.

It is conceded that the petitioner has directly approached this Court and has not approached the Jail Superintendent for modification of the order, despite the said order having been passed by the said Jail Superintendent.

The learned advocate for the petitioner submits, on

*2* 16wp577o21 instructions, that he would approach the Jail Superintendent within three days seeking relaxation/ modification in some of the conditions as are set out in the order dated 27.11.2020. If such an application is filed, he prays for an expeditious decision. The learned prosecutor submits that such an application would be decided within four days after it's receipt. 5.

In view of the above, this Criminal Writ Petition is disposed off. The petitioner can make an application for modification of the order dated 27.11.2020 to the Jail Superintendent within three days. In the event, such an application is filed, the said Jail Superintendent shall decide the same within four days from it's receipt. 6.

Since the learned advocate Shri Nirmal was appointed by this Court, we quantify his fees at Rs.1000/- (Rupees One Thousand) to be paid by the High Court Legal Services Sub Committee, Aurangabad. kps (B. U. DEBADWAR, J.) (RAVINDRA V. GHUGE, J.)
