PER COURT :- 1) The applicant/petitioner has filed this application seeking permission to serve the Respondents by way of paper publication. It is submitted that the addresses which are mentioned of all these respondents in the petition are based on the addresses of the said respondents in the proceedings before the lower court. It is further submitted that the notices issued to the respondents on the said addresses have returned unserved on the ground that the respondents are not residing on the given addresses. In the circumstances, the learned Counsel has prayed to serve all these respondents by BDV
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD by way of paper publication.
2) For the reasons stated in the civil application and considering the fact that the notices are returned unserved on the ground that the respondents are not residing on the given addresses, the civil application is allowed.
3) The applicant/petitioner shall take necessary steps for publication of notices in two local newspapers having wide circulation in the area wherein the said respondents are residing. Notice returnable after six weeks.
