2025:BHC-AUG:20480-DB ( 1 ) 945 wp 8835.25
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 945 WRIT PETITION NO. 8835 OF 2025 JANARDHAN SHRIPATI KAGDE
VERSUS
THE STATE OF MAHARASHTRA THROUGH SECRETARY AND OTHERS .....
Advocate for the Petitioner : Mr. Suraj P. Tiwari (through VC) AGP for Respondents/State : Mr. V.M. Kagne .....
CORAM : MANISH PITALE & Y.G. KHOBRAGADE, JJ.
DATE :
1st August, 2025 P.C. :- 1.
After having heard the learned counsel for the Petitioner for some time, we find that the central grievance of the Petitioner is that certain mutation entries concerning him in the record of rights were allegedly illegally changed / modified over a period of time. 2.
Instead of taking appropriate steps under the Maharashtra Land Revenue Code, 1966, it appears that the Petitioner has been sending merely representations to various authorities including the Block Development Officer, the Chief Executive Officer of the Zilla Parishad, inter alia, seeking criminal action to be initiated against the Sarpanch, UpaSarpanch, Gramsevak of the concerned Gram Panchayat.
( 2 ) 945 wp 8835.25 3.
We are of the opinion that if the Petitioner is aggrieved by certain mutation entries pertaining to record of rights, the Maharashtra Land Revenue Code provides a detailed machinery to air such grievances in accordance with law.
4.
Such a petition under Article 226 of the Constitution of India cannot be entertained in the facts and circumstances of the present case. Hence, the Writ Petition is dismissed. Needless to say the Petitioner would be at liberty to approach the concerned Authorities under the aforesaid Code in accordance with law. We have not expressed any opinion on the merits of the claim made by the Petitioner. Pending applications, if any, also stand disposed of.
