Heard the learned counsel for the applicant and learned APP for the respondent-State. 2.
The applicant was directed to deposit Rs.2,00,000/- while granting him Anticipatory Bail. He accordingly deposited the said amount with the learned Judicial Magistrate First Class, 4th Court at Udgir, Dist. Latur.

The learned counsel for the applicant would submit that the applicant had been discharged by order of this Court passed in Criminal Writ Petition No.731/2018. No case remained pending against the applicant. The order of the Anticipatory Bail has been merged, therefore, the amount deposited by him may be refunded.

The learned APP has verified whether the
(2) 941-appln-1563-2022 order of discharging the applicant has been challenged. He would a make statement that he has verified, but there is no proposal to challenge the order discharging the applicant.

In view of the fact, the applicant is entitled to get Rs.2,00,000/- refunded alongwith interest if the amount is deposited in Fixed Deposit.
Therefore, the learned Judicial Magistrate First Class, 4th Court, Udgir, Dist. Latur is directed to release the amount of Rs.2,00,000/- alongwith interest if the amount is deposited in Fixed Deposit deposited by the applicant as per the order of this Court at the earliest.
