While issuing notice in Criminal Revision Application No. 195 of 2021, this Court by order dated 20.12.2021 was pleased to direct the applicant/husband to deposit an amount of Rs. 4,00,000/- (Rs. Four Lakh only) as a condition towards stay to the impugned order. The husband has deposited the said amount in this Court. The details are given in paragraph No. 6 of the application.

It is now submitted that there is settlement between the parties wherein, the husband has agreed to pay to wife an amount of Rs. 50,00,000/- (Rs. Fifty Lakh only) towards settlement. The terms of settlement are forms a part of decree. It is further agreed between the

2 3-appln 1561-2022.odt parties that the amount that is deposited in this Court of Rs. 4,00,000/- (Rs. Four Lakh only) is to be withdrawn by the applicant/husband. In view of this, the present application is filed for withdrawal of the amount.

In view of the above, Criminal Application No. 1561 of 2022 is allowed.

The office is directed to allow the applicant/husband to withdraw an amount of Rs. 4,00,000/- (Rs. Four Lakh only) deposited in this Court pursuant to the order dated 20.12.2021 passed in Criminal Application No. 3207 of 2021 in Criminal Revision Application No. 195 of 2021 and if any accrued interest amount on it. 5.
