IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CRIMINAL APPLICATION NO.2314 OF 2016 Somnath s/o Ashok Darekar ..APPLICANT

VERSUS

The State of Maharashtra ..RESPONDENT Mr N.B. Narwade, Advocate for applicant;

Mr S.Y. Mahajan, Addl. Public Prosecutor for respondent; Mr N.V. Gaware, Advocate to assist Addl. Public Prosecutor CORAM : N.W. SAMBRE, J.

DATE : 20th June, 2016 ORAL ORDER :

Heard.

2.

The applicant is seeking pre-arrest bail, in connection with C.R. No.70 of 2016, registered with Ahmednagar Taluka Police Station, Ahmednagar, for offences punishable under sections 306, 498-A read with section 34 of the Indian Penal Code.

3.

The applicant's brother was married to deceased Rupali. The applicant and his brother are serving in Armed Forces, whereas deceased Rupali was serving as a Post-woman.

4.

The allegation against the applicant is that deceased Rupali was subjected to illtreatment, so as to extort money for the purpose of giving bribe for employment of the applicant.

(2) 5.

There is hardly any material in the investigation to connect the present applicant to the crime in question. Deceased Rupali has died in a hospital, whereas the applicant is serving in Armed Forces and posted at Ahmednagar.

6.

In the above background, in my opinion, it will be appropriate to enlarge the applicant on pre-arrest bail. I, therefore, pass following order :- In the event of arrest of the applicant, in connection with C.R. No.70 of 2016, registered with Ahmednagar Taluka Police Station, Ahmednagar, for offences punishable under sections 306, 498-A read with section 34 of the Indian Penal Code, he be released on bail, on furnishing P.R. Bond of Rs.15,000/- with one surety in the like amount. The applicant shall attend the concerned police station as and when called, under written intimation to be issued by the Investigating Officer. Criminal Application stands allowed in above terms. (N.W. SAMBRE, J.) amj
