PER COURT :- It is noticed that, the Maharashtra Administrative Tribunal has already issued directions in Original Application No.212 of 2003, to the Accountant General Nagpur to decide the family pension case of the original applicant and time limit has been specified in the order, as three months from the date of issuance of order. It is further noticed that, petitioner has moved Contempt Application No.83/2005 before the Maharashtra Administrative Tribunal. The petitioner, however, has not disclosed the presentation of the Contempt Application to the tribunal and the result thereof. Since the petitioner has already availed of remedy prescribed under the Administrative Tribunals Act and has also secured an order in the Original Application No.212/2003, the instant petition is not entertainable and as such, stands disposed of. No costs.
