The applicant challenges the order dated 01.01.2024, passed by the Additional Sessions Judge, Beed in Criminal Appeal No.46/2021 thereby directing the present applicant to pay the arrears of maintenance &, order dated 24.10.2019, passed by the J.M.F.C., Patoda below Exhibit-4 in Misc. Criminal Application No.70/2018 granting interim maintenance to the applicant's wife and daughter amounting to of Rs.4,000/- i.e. Rs.2,000/- each. It is submitted that there is an outstanding amount of about Rs.2,00,000/-.

This court asked, whether the applicant is ready to deposit at least 50% of the outstanding amount to which the learned counsel for the

2 912 applicant, on instructions, submits that the applicant would not be in a position to deposit the same.

The contention of the wife in the application seeking maintenance that the present applicant / husband is earning about Rs.40,000/- to 45,000/- and the same is not disputed by the applicant in his written statement. So also, considering that the maintenance of Rs.2000/- to the wife and Rs.2000/- to the minor child is not exorbitant, prima facie, the impugned orders are not erroneous. 5.
