The petitioners seek rental compensation. It appears that application has been made to the Executive Engineer i.e. acquiring body. In fact, the application ought to have been made to the Special Land Acquisition Officer for granting the rental compensation.

The petitioners may file an application along with the Special Land Acquisition Officer / competent authority for grant of rental

If such an application is filed, the authority shall decide the same on its own merits, in accordance with law, expeditiously and preferably within a period of nine (09) months from the date of receipt of the application after hearing all parties concerned. All contentions of respective parties are kept open.

Writ Petition is disposed of. No costs.
