After hearing the learned counsel for the petitioner, when this Court was not inclined to interfere in the impugned order, the learned counsel for the petitioner, on instructions, sought leave to withdraw the petition with a liberty to permit the petitioner to deposit the balance 50% amount before the learned Trial Court within a period of three months. His statement is accepted. Leave is granted.

In view of the above statement, the present petition is dismissed as withdrawn.

The petitioner is directed to deposit the remaining 50% amount before the learned Trial Court within a period of eight (08) weeks from today. It is made clear that no further time will be granted. In the event of Shrikant Malani
