BENCH AT AURANGABAD CIVIL APPLICATION NO.6129/2016 IN FIRST APPEAL NO. 2083/2014 THE GODAVARI MARATHWADA IRRIGATION DEVELOPMENT CORPORATION THROUGH THE EXECUTIVE ENGINEER VS THE STATE OF MAHARASHTRA AND ORS.

...

Mrs. Rekha K.Laddha, Adv. For Appellant;

Mr.PG Borade, AGP for State.

----- CORAM : P.R.BORA, J.

DATE :

2 nd May,2016.

PER COURT :

1) Heard.

By filing the present application, the appellant/applicant is praying for permission to deposit the amount of compensation by extending the time, which was provided for deposit of such amount.

2) Learned Counsel appearing for the appellant/applicant submitted that against the Judgment and Award passed in LAR Nos. 71/2003 and 74/2003 by the Civil Judge, Senior Division, Nanded, the appellant/applicants have preferred the appeals. It is further brought to my notice that this Court had directed the appellant/applicant to deposit the entire amount of Awards under the respective LARs. However,

the appellant/applicant could not deposit the said amount within the stipulated period. The learned Counsel submitted that she is now in receipt of common cheque for the whole of the amount covering the amount under both the Awards, i.e. In LAR No.71/2003 and 74/2003. The learned Counsel has prayed for permitting the appellant/applicant to deposit the said amount by condoning the delay which has caused in depositing the said amount.

3) For the reasons stated in the application, the delay caused in depositing the amount is condoned and the appellant/applicant is permitted to deposit the amount.

4) Registry to accept the cheque for the said amount.

5) The civil application stands disposed of.
