The learned Counsel for the appellant filed purshis alongwith communication dated 18th January 2023. It is taken on record and marked "X" for identification. As per the aforesaid communication the appellant Insurance Company does not want to proceed with the appeal and has authorised it's learned Counsel to withdraw the appeal. In view of the same, the appeal stands withdrawn and disposed of alongwith pending civil applications, if any. Court fees be refunded as per rules.

The learned Counsel for the original claimant i.e. respondent No.1 requested that the claimant be permitted to withdraw the balance amount of compensation. The learned
