We have heard Mr. Bolkar, learned advocate for the petitioner and Smt. Dube, learned advocate for respondent Nos. 3 and 4.

The grievance of the petitioner appears to be that because of the supervening circumstances, the petitioner had to cancel his admission with respondent college and had to take admission at Vaidyanath College, Parli-Vaijnath. Respondent Nos. 3 and 4 are not issuing the transfer certifcate. 3.

Smt. Dube, learned advocate for respondent Nos. 3 and 4 submits that the petitioner has not deposited fees of Rs.20,000/-, so also the institution received the guidelines from the Secondary School Board recently about the manner in which

WP No.6521/21 the assessment of the students of 11th standard has to be conducted. Within two weeks the assessment of the petitioner for 11th standard would be conducted and upon the petitioner depositing Rs.20,000/- transfer certifcate would be issued. 4.

Mr. Bolkar, the learned counsel on instructions submits that petitioners would once again deposit Rs.20,000/- with respondent No. 4 though entire fees is paid. 5.

Respondent Nos. 3 and 4 would assess the performance of the petitioner for 11th standard as per the guidelines received from Secondary School Board within one weeks. The petitioner shall deposit Rs.20000/- with respondent No. 3/4 within one weeks.

Upon the petitioner depositing Rs.20,000/- and respondent Nos. 3 and 4 completing the assessment of the petitioner for 11th standard, the respondent No. 4 shall issue transfer certifcate to the petitioner in consonance with the assessment made by the respondent No. 4.

Writ petition disposed of. No costs.
