Heard learned Advocates for the parties.

At the very outset Mr. Shekade, learned Advocate for the Applicant and Mrs. Sangit, learned APP for the State has drawn my attention to the order dated 5 May 2025 by which the Court protected the Applicant by an interim order in the terms and conditions is recorded in the paragraph No.6. The said order duly records the details of the FIR the incident and the alleged sections as invoked in the FIR. Mrs. Sangit, on instructions, would submit that the investigation is over. On the aspect of prima facie case there is the prosecution has nothing further to place on record pursuant to the order dated 5 May 2025. As submitted by learned APP, on instructions, the Applicant has co-operated with the investigation. There is no breach of conditions of the order dated 5 May

2025. The Applicant has thus joined the investigation. In such circumstances, the custodial interrogation of the Applicant would no longer be necessary. The interim order dated 5 May 2025 is hereby confirmed. In my view, the following order would meet the ends of justice.

ORDER

(i) In the event of arrest of the Applicant in connection with C.R. No. 94/2025 registered with Waluj Police Station, Dist. Chatrapati Sambhajinagar (City) for the offences punishable under Sections 115(2), 3(5), 308(5), 308(7), 351(2), 351(3), 352 of the BNS, the applicant is directed to be released on bail on his furnishing PR bond in the sum of Rs. 20,000 (Rupees Twenty Thousand Only) with one solvent sureties in the like amount.

(ii) The Applicant shall cooperate with the investigation. He shall attend the concerned police station as and when call by the Investigating Officer till filing of the charge-sheet. (iii) The Applicant shall furnish details of residential address and other contact details such as mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately informed to the concerned police station.

(iv) The Applicant shall not leave the jurisdiction of the Court without prior permission of the Court until further orders. (v) The Applicant shall not interfere with the evidence and shall not tamper prosecution witnesses in any manner whatsoever.

Needless to mention that these are prima facie observations

made in adjudicating this ABA.

The ABA is allowed in above terms.
