Mr.Jadhavar, learned counsel states that the petitioner was selected for the post of Assistant Sheet Metal from SC category. He had secured 39 marks. However, in the final selection list, the name of the petitioner is deleted. The petitioner though is meritorious and has more marks, his name is deleted and less meritorious candidate like one Jankar Sham Bhanudas is considered. 3.

Mr.Chapalgaonkar, learned counsel submits that said Jankar is appointed from NT2(C) category. Earlier, petitioner was shown to have been selected from SC female category but as female candidates are available, the name of petitioner is deleted. The

learned counsel makes a statement that no candidate below the petitioner is appointed from SC apprentice category. 4.

As the female candidates are available, the petitioner, who is male, certainly could not have been appointed in the female category. Considering the statement made by MKCL that no person below the petitioner in merit has been appointed from SC apprentice category, the Writ Petition is disposed of. No costs. (V.L.ACHLIYA,J.)
