Mr.Jadhavar, learned counsel submits that the petitioner has secured 48 marks and he had applied from NT(D) category. The petitioner is non-apprentice. According to the learned counsel, one Mr.Tandale who has got 47 marks is shown in the select list though he has received less marks than the petitioner. The same is not permissible.

Mr.Chapalgaonkar, learned counsel submits that initially there was a mistake in the select list as MSRTC had not properly given instructions. In the final select list not a single candidate below the petitioner is appointed from NT(D) non-apprentice
category for the post of Assistant Sheet Metal. 4.
In view of the said statement made by the learned counsel for MKCL that no candidate below the petitioner in merit is appointed from NT(D) category, the claim of the petitioner can not be considered.
