Perused the affidavit filed by Respondent No.3 - Raju Madhavrao Deshmukh, Executive Engineer, Nanded. In view of the affidavit filed there is no case made out for contempt.

The learned counsel appearing for the petitioner submits that the entire amount as directed by the reference court has not been paid. The learned counsel submits that although the respondents submit that they have paid the entire amount, as per the computation made by the petitioner, the entire amount is not paid.

The petitioner is at liberty to take such appropriate steps as are available in law for the recovery of the said amount by initiating appropriate proceedings.

The contempt petition stands disposed of.
