This application is for transfer of matrimonial proceedings bearing M.P. No. 1498/2023 from the Court of learned Civil Judge Senior Division, Pune to the Court of learned Civil Judge Senior Division, Majalgaon, District Beed. The applicant - wife is residing at Wadwani. Since there is no Court of learned Civil Judge Senior Division at Wadwani, a prayer is made to transfer the proceedings to the Court of learned Civil Judge Senior Division, Majalgaon.

The applicant - wife has already filed two proceedings in the Court at Wadwani wherein, the husband has appeared. The distance between two cities is 250 kms. It is stated that, the wife find it difficult to travel such a long distance as there is no one to accompany her in the family.

The learned advocate for respondent vehemently opposes the application. He submits that, the wife is residing at Wadwani and not at Majalgaon. In any case, she is required to travel to attend the Court proceedings. The husband is ready to bear the travelling expenses to the wife if she personally appears. 5.

Considering that, two proceedings are already pending at Majalgaon wherein, husband has already appeared and looking to the convenience of the wife , this Court finds that, it is in the interest of justice to transfer the proceedings to the Court at Majalgaon. Hence, following order :

ORDER

(I) Misc. Civil Application stands allowed in terms of prayer clause (B).

(II) After transfer of the proceedings, the applicant - wife shall

3 930-MCA 143-2025.odt not seek unnecessary adjournments. If the learned Court finds that, the adjournments are sought unnecessarily, the Court may pass appropriate order compensating the respondent - husband if he personally remains present.

(III) If a request is made by the respondent - husband to appear through video conferencing facility, the same shall be considered liberally by the learned Court.

(IV) After transfer of the proceedings, the learned Trial Judge to expedite the proceedings and try to dispose of the same within one year from today.
