Upon careful perusal of the impugned communication by the Education Officer (Secondary), Zilla Parishad, Osmanabad to the petitioner, it appears that, Education Officer had not taken into consideration the services rendered by the petitioner from 1st November, 1985 to 11th June, 1995 and two days period after 2007. 3.

However, upon perusal of the pleadings in the Petition, it is stated by the petitioner that, the petitioner has worked in an aided school from 12th June, 1995 to 31st March, 1998 namely Urdu High School, Omerga and same has not been taken into consideration by the Education officer. It further appears that, while considering the case of the petitioner, the Respondent - Education Officer has also

not taken into consideration, the decision taken by the State Government in respect of Shri. Abdul Hamid Abdul Latif Mulla, who was working as assistant teacher and similarly situated employees like the petitioner.

In the abovestated circumstances, we set aside the impugned communication/order passed by the Education Officer. We direct the Education Officer (Secondary), Zilla Parishad to consider the contentions of the petitioner that, he has worked in an aided school from 12th June, 1995 to 31st March, 1998. The Education Officer shall verify the record maintained by his office and allow the petitioner to produce on record the documentary evidence in support of his contentions that, as a matter of fact he has actually worked from 12th June, 1995 to 31st March, 1998 in Urdu High School and thereafter take an appropriate decision, as expeditiously as possible, preferably on or before 30th May, 2015.

The Petition stands disposed of accordingly.
