One prayer of the Petitioner, who is a private contractor is that his pending bills should be cleared. The second prayer is that action be initiated against Respondent No.4, for not clearing the bills. 2.

Since this Court ought not to indulge in recovery of bills of private contractors and as the issue as to whether Respondent No.4 is guilty of delaying the payment, is a contentious and disputed issue, we expressed our disinclination.

The learned Advocate for the Petitioner submits that the Petitioner desires to withdraw this Petition and prefer a suit for recovery of unpaid amounts.
