PER COURT:- 1] The petitioners are praying for issuance of directions to the respondents to allow them to tender examination fees which they could not deposit on-line before the deadline i.e. 13.3.2018 and to permit them to appear for National Eligibility-cum-Entrance Test-2018 (hereinafter referred to as , 'NEET (UG)- 2018 examination').
2] Similar request is also made by a few candidates in respect of MHT-CET 2018 examination. NEET (UG) - 2018 examination is scheduled on 6th May, 2018, whereas, MHT-CET examination is scheduled on 10th May, 2018. The total number of applicants for NEET (UG) - 2018 examination are about 13,14,944 and the left out candidates for one or the other reason are 14,219. 3] It is the contention of the CBSE which is authorized to make arrangements for examination that all arrangements for the examination have been made and at this stage, no new candidate could be allowed to appear for NEET (UG)-2018 examination, since there are only two days left out for the examination. It is further contention of respondent CBSE that in this examination, the text booklet of OMR are provided equal to number of candidates registered in the examination, and as such, the CBSE is not having additional text booklets of question papers which could be distributed to the additional students. It is further pointed out that a similar grievance was
{3} made before the Delhi High Court by a petitioner, namely Anu Yadav, by presenting a writ petition No. 2847 of 2018. The learned Single Judge, after hearing the arguments has dismissed the writ petition, by order dated 6.4.2018. The order passed by the learned Single Judge has been confirmed by the Division Bench of the same court on 25.4.2018 and it is further informed that the Special Leave Petition presented challenging the said decision bearing No. 221 of 2018 has been dismissed by the Honourable Apex Court today.
3] Considering the facts and circumstances enumerated above, and considering the fact that the problem faced by the respondent authorities conducting MH-CET examination are not different than those, which have been put forth by the CBSE, the request made by the petitioners to allow them to appear for both the examinations, does not deserve to be considered favourably. Writ petitions being devoid of substance, stand rejected. No costs.
