This petition is filed challenging the government resolution dated 23 September 2016 and for a further direction to the respondent Nos. 1 and 2 to provide reservation for the post of Principal in Institutions running multiple colleges imparting similar course of education and to make roaster point applicable to such appointment/s on the post of Principal.

On 21 June 2022, the petitioner had brought to our notice the provisions of Maharashtra Educational Institutions (Reservation in Teacher's Cadre) Act 2021 and the consequent notification dated 7

2 927 wp 7457-21 April 2022 issued under said Act. The learned counsel for the petitioner in all fairness pointed out that the Act and notification now provide that the reservation would be applicable to the teaching cadre as defined under said Act and thus grievance of the petitioner stands redressed.

Today, the only contention raised on behalf of the petitioner is that the provisions of the Act and the notification should be made applicable to the on going recruitment process. We are unable to examine the said issue as the same has not arisen in the petition. Thus, keeping the said issue open, this petition is disposed of in view of the framing of the said Act and issuance of the notification thereunder. There shall be no order as to costs.
