PER COURT :

The challenge in this Second Appeal is to the judgment and decree granting maintenance to a minor child and wife of the appellant herein. It was a suit for maintenance under Section 18 of the Hindu Adoption and Maintenance Act. The appellant was serving as a Teacher. The trial Court granted maintenance of Rs.1500/- per month to the respondent - wife and Rs.1000/- to the minor son until attaining majority. Admittedly, the son has attained majority. As such, the appellant herein has to pay not more than Rs.1500/- per month as maintenance to his wife.

It is informed by learned counsel for the appellant that, the appellant has himself filed a petition for dissolution of marriage by a decree of divorce. The same indicates that he does not wish to cohabit with his wife. After having gone through the judgment of the trial Court and that of the first appellate Court, this Court finds no substantial question of law to have been involved in the present Second Appeal. The Second Appeal, therefore, stands dismissed.
