Heard learned Counsel for the petitioner, learned AGP for the State and learned Counsel for the respondent No.1.
This petition takes exception to the summons dated 18th April, 2012 issued by respondent No.1 Committee calling upon the petitioner before respondent No.1 committee.
The learned Counsel for the petitioner submits that in similar fact situation, this Court
4293.12wp has disposed of Writ Petition No.4283 of 2012 (Balaji Rajanna Kanlod vs The ST. Caste Certificate Verification Committee, Aurangabad & ors.) along with connected writ petitions. He submits that this petition can also be disposed of for the same reasons which are assigned in the said order. However, learned Counsel for the petitioner submits that the petitioner should be at liberty to bring to the notice of the respondent No1. Committee the unreported judgment of this Court rendered on 26th August, 2008 in Writ petition No.5079 of 2008 (Ganesh s/o Murlidhar Siraskar vs State of Maharashtra & ors.).
We have carefully perused the order passed by this Court in Writ Petition No.4283 of 2012 along with connected petitions. We dispose of this writ petition for the reasons stated in said order and in particular, paragraphs 4 and 5, except the bracketed portion in para 5 i.e. "It is only after the petitioner files reply to the show cause notice and thereafter if the Committee is not satisfied and proceeds further, then the petitioner would have a right to assail the action of committee."
Petition stands disposed of, accordingly.
