It appears that one post was advertised by Respondent-Management as the said post had fallen vacant due to termination order issued to Mr. Bhanudas. The said post was filled-up and respondent No.6 came to be appointed. Said Bhanudas challenged the order before the School Tribunal and the appeal was allowed. As there was an order of reinstatement, Bhanudas came to be reinstated on that post. The petitioner wanted to claim the said post by way of promotion as he was
