The applicant is seeking bail under Section 439 of the Code of Criminal Procedure in Crime No. 801/2020 registered with Shirdi Police Station, District Ahmednagar for the offences punishable under Sections 307, 367, 394, 397, 452, 341, 323, 504, 506 read with Section 34 of the Indian Penal Code and under Section 4/25 of Arms Act. 2.
After having heard both the sides, it transpires that this Court has granted bail to the co-accused Ravindra Balasaheb Bairagi in Bail Application No.178/2021 by the order dated 16.03.2021. 3.
Going by the allegations, except the fact that the rickshaw allegedly used in crime is recovered from the applicant, the role attributed to the applicant and co-accused Ravindra Balasaheb Bairagi is exactly the same. For the reasons, therefore, as mentioned in the order dated 16.03.2021, even the present applicant deserves bail. 1/2

The application is allowed. The applicant be released on bail in connection with Crime No.801/2020 registered with Shirdi Police Station, District Ahmednagar for the offences punishable under Sections 307, 367, 394, 397, 452, 341, 323, 504, 506 read with Section 34 of the Indian Penal Code and under Section 4/25 of Arms Act on furnishing personal recognizance for an amount of Rs.50,000/- with two solvent sureties of Rs.25,000/- each on following conditions :
a) The applicant shall not tamper the evidence or influence the witnesses in any manner.
b) The applicant shall not indulged in any criminal activity. c) Before submission of bail papers, the applicant should give complete address of his residence with his mobile number. So also he should comply with the requirements under paragraph No.12 (1) to (6) of Chapter I of Criminal Manual, whichever are applicable.
d) Bail before the trial court.
