Mr.M.P.Kale submits on instructions that the appellants do not desire to pursue with the second appeal and they be permitted to withdraw the same.

The appellants have made a request for refund of the court fees deposited. In the light of withdrawal of the second appeal, court fees be refunded to the appellants in accordance with the rules applicable.
