PER COURT :- 1) Heard learned Counsel for respective parties.

2) Considering the averments made in the application for withdrawal of the amount and having regard to the objections raised by the appellant/insurance company in exception to the Award impugned in the present appeal, I deem it appropriate to pass the following order,-

ORDER

i) At present, the applicant nos. 1 & 4 are permitted to withdraw 50% of the deposited amount BDV

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD falling to their share in terms of the Award pased by the Tribunal on an undertaking that in the event any adverse order is passed, they will re-deposit the said amount within four months of passing such order;

ii) The balance amount be invested in Fixed Deposit Receipt (FDR) in any Nationalized Bank, initially for a period of two years and if so required for the period till disposal of the appeal. CA stands disposed of.
